Inspector Network LLC, d/b/a Inspector Studio
This Web Hosting Services Agreement ("Agreement") is between Inspector Network LLC, doing business as Inspector Studio ("Inspector Studio," "we," "us," or "our"), and the individual or business purchasing standalone web hosting services ("Customer" or "you"). This Agreement applies whether you purchase hosting on its own or as part of a website design purchase; the design work itself is governed by our Website Design Agreement. By purchasing hosting, submitting an order, or electronically accepting this Agreement, you agree to the terms below.
Inspector Studio provides web hosting through a full cPanel account with unrestricted access, allowing you to manage your own files, databases, email accounts, DNS, and installed software ("Hosting Services"). You retain full ownership of your website, content, and data at all times — hosting is infrastructure and account access only, and does not create or transfer any ownership interest. Because you control the account, you are responsible for what you install and run on it, subject to Section 5 (Acceptable Use).
Hosting is billed at $20.00 per month or $200.00 per year, depending on the billing interval you select, due in advance on your billing date, and renews automatically until canceled. You are responsible for any applicable sales, use, or similar taxes. Fees already paid are non-refundable except as required by law or expressly stated in this Agreement.
If your hosting was included with a website design purchase, no hosting fee is charged for the first 12 months, starting when design work begins. We will give you reasonable notice before hosting charges begin; after that, hosting continues at the rates above unless you cancel under Section 3.
Hosting continues on a recurring basis until you cancel or we terminate it under Section 11. You may cancel at any time; cancellation takes effect at the end of your current billing period, and we do not charge an early-cancellation fee.
Because your cPanel account gives you full, unrestricted access, you are responsible for the software you install, the content you publish, keeping that software patched and secure, and the security of your own account credentials. We are not responsible for problems caused by software, plugins, themes, or scripts that you or someone you authorize installs, including vulnerabilities in that software.
You may not use Hosting Services to: host or distribute illegal content; send spam or unsolicited bulk email; distribute malware, viruses, or phishing content; attempt unauthorized access to other systems; run denial-of-service attacks; infringe someone else's intellectual property; or consume a disproportionate share of shared server resources (CPU, memory, bandwidth, or storage) in a way that affects other customers. We may ask you to correct a violation, throttle resource-intensive processes, or suspend the affected service under Section 11 if it is not resolved.
We use commercially reasonable efforts to keep the hosting environment available, secure, and performing well, including on shared infrastructure used by multiple customers. We do not guarantee uninterrupted or error-free service, and hosting may be temporarily unavailable for maintenance, upstream provider issues, security events, or other circumstances outside our reasonable control.
Your account is hosted on a cPanel-based server, and DNS for your domain may be served through our geographically distributed DNS cluster (currently including locations in San Francisco, CA; Newark, NJ; and London, UK) for redundancy. We may change server locations, DNS infrastructure, or providers from time to time as reasonably necessary for performance, security, or operational reasons.
If your hosting includes email, we will use commercially reasonable efforts to configure standard authentication (SPF, DKIM, and DMARC where applicable), but we do not guarantee email delivery or inbox placement — these depend on factors outside our control, including the reputation of shared mail infrastructure and the practices of recipient providers.
You are solely responsible for maintaining your own backups of your website, files, databases, and email. We may maintain backups of the hosting environment according to our own practices, but backups are not guaranteed to capture every version of your content and should not be treated as a substitute for your own backups. We are not liable for data loss, including data loss resulting from your own actions, your installed software, or a security incident affecting your account.
We use commercially reasonable practices to secure the hosting infrastructure we control. No Internet-connected system can be guaranteed to be completely secure, and we do not warrant that your account will be immune from hacking, malware, or other security incidents — particularly because your unrestricted access means you control what is installed and how it is configured. We may take reasonable action, including temporary suspension, to contain a security incident affecting your account or our broader infrastructure.
Your hosting account, control panel, email accounts, and anything sent from your domain are your responsibility. That includes activity by anyone you have given access to, and activity that results from a compromised, shared, or weak password. You agree to use reasonable security practices — strong, unique passwords; limiting who has access; and acting promptly if you suspect an account has been compromised — and to comply with applicable law, including anti-spam laws such as CAN-SPAM, in anything sent through your hosting account or domain.
If your account sends spam or unlawful messages, distributes malware, or otherwise violates the law or Section 5 (Acceptable Use) — even unintentionally, such as when a hacked mailbox is used to send spam — we may suspend the affected service without advance notice, to the extent necessary to stop the harm. We will notify you as soon as reasonably practical and work with you to restore service once the cause has been fixed.
Your website and email run on infrastructure shared with other customers. If your account causes or threatens harm to other customers, our platform, or our standing with mail providers and networks, and the cause is not something we did — for example, a change you made in your control panel, a script or plugin you installed, or credentials you shared — we reserve the right to suspend or discontinue service to protect the other users of the platform. We will limit suspension to what is needed to address the problem and give you a reasonable opportunity to fix it before ending service permanently, unless the conduct is repeated or the harm is serious. Suspension or termination for these reasons does not cancel amounts you owe.
If a payment is not received when due, we will give you 7 days' notice to bring your account current before suspending Hosting Services. We may suspend or terminate Hosting Services immediately, without notice, if we reasonably believe it is necessary to address a security threat, an Acceptable Use violation, illegal activity, the platform-protection reasons described in Section 10, or conduct that threatens our infrastructure or other customers. Suspension or termination does not cancel amounts you owe. After termination, we will give you a reasonable window to export your files and data before we permanently delete them from active systems — typically 30 days, unless a shorter window is necessary for security reasons.
You are responsible for owning, registering, and renewing your own domain name. If we assist with DNS or registrar configuration, that does not give us any ownership over your domain, and we are not responsible for a domain controlled by you or a third-party registrar.
We do not guarantee any particular search-engine ranking, website traffic, leads, sales, or other business outcome, and we do not provide legal advice — you are responsible for making sure your site's content and any required disclosures comply with applicable law.
You agree to defend and cover us for third-party claims arising from content you host, software you install, or your use of Hosting Services in violation of this Agreement or applicable law. This does not apply to claims arising from our own work or negligence.
Neither party is liable for indirect, incidental, or consequential damages (such as lost profits or lost data) arising from this Agreement. Our total liability for any claim related to your Hosting Services is capped at the amount you actually paid us for those services in the 12 months before the claim arose. Nothing in this Agreement limits liability that cannot legally be limited.
Each party will keep the other's non-public business information confidential and use it only as necessary to perform this Agreement, unless disclosure is required by law.
This Agreement is governed by Florida law, and any dispute will be resolved in the Florida county where Inspector Network LLC is based. Each party bears its own attorneys' fees unless a court or applicable law says otherwise. If any part of this Agreement is found unenforceable, the rest remains in effect. We may update this Agreement going forward, with reasonable notice for changes affecting ongoing service. Your electronic acceptance of this Agreement is binding. This Agreement, together with your order, is the entire agreement between us regarding Hosting Services and supersedes anything discussed beforehand, unless a separate written agreement expressly says otherwise.
By purchasing Hosting Services, placing an order, or indicating your agreement during checkout, Customer acknowledges having read and agreed to this Agreement.
